- Our GTC apply to all our sales transactions with products and services offered by The Uncommon Shop GmbH. We only sell to consumers within the meaning of § 13 BGB (hereinafter also referred to as “customer/s”). Deviations from the GTC are only effective if we confirm them in writing.
- Each customer is only authorized to have or create one customer account.
- The prices stated on “The Uncommon Shop” are gross prices (i.e. including VAT), but do not include any packaging and transportation costs.
- The presentation of the products on “The Uncommon Shop” page is not a legally binding offer, but only a non-binding online catalog of our product range. By clicking on the “Buy” button, the customer places a binding order for the goods contained in the shopping cart. We will confirm receipt of the order immediately. The text of the contract is saved and the order data and the General Terms and Conditions are sent to the customer by e-mail.
- We reserve the right not to provide the ordered service if it should transpire after conclusion of the contract that the ordered goods or the ordered quantity are not available. In such a case, the customer will be informed immediately. Any payments already made will be refunded immediately. Further claims against us are excluded.
- If the item is in stock, the delivery time varies depending on the delivery method selected. Further information can be found under the button “”. We use the Swiss Post for delivery.
- The shipping costs correspond to the costs listed on the “Shipping” page.
- The goods remain the property of The Uncommon Shop GmbH until full payment has been received.
- Statutory right of withdrawal
9.1 Right of withdrawal
If the customer is a consumer within the meaning of § 13 BGB, he has the right to withdraw from this contract within seven days without giving reasons. The 7-day period begins from the day on which the customer placed the order with us. As a gesture of goodwill, we usually also allow the order to be canceled after the seven days, but only for 90% of the purchase price. Cancellation after the seven days is optional and we reserve the right to cancel this as well. To exercise the right of withdrawal, the customer must inform us(The Uncommon Shop GmbH, Bahnhofstrasse 16, 8590 Romanshorn, phone: 0041 71 571 08 05, e-mail: info@theuncommonshop.ch) of his decision to withdraw from this contract by an unequivocal statement, e.g. by post or e-mail. In order to comply with the withdrawal period, it is sufficient for the customer to send the notification of the exercise of the right of withdrawal before the expiry of the withdrawal period.
9.2 Consequences of revocation
If the customer withdraws from this contract within 7 days, we shall reimburse all payments we have received from him, including delivery costs (with the exception of additional costs resulting from the fact that the customer has chosen a different type of delivery than the cheapest standard delivery offered by us), immediately and at the latest within fourteen days from the day on which we receive notification of the cancellation of this contract. After the 7 days, we reserve the right to refund only 90% of the purchase price. For this repayment, we will use the same means of payment that the customer used for the original transaction, unless expressly agreed otherwise; in no case will the customer be charged any fees for this repayment. We may withhold the refund until we have received the goods back or until the customer has provided proof that the goods have been returned, whichever is the earliest.
The customer must return or hand over the goods to us immediately and in any case within seven days at the latest from the day on which he informs us of the revocation of this contract. The deadline is met if the customer sends the goods before the seven-day period has expired. We shall bear the costs of returning the goods.
The customer shall only be liable for any loss in value of the goods if this loss in value is due to handling of the goods that is not necessary to check their condition, properties and functionality.
9.3 Exclusion of the right of withdrawal
The right of withdrawal does not apply to:
- Delivery of goods which are not prefabricated and for the manufacture of which an individual selection or determination by the consumer is decisive or which are clearly tailored to the personal needs of the consumer,
- From the 8th day after receipt of the order.
- Delivery of sealed goods that are not suitable for return for reasons of health protection or hygiene if their seal has been removed after delivery,
- Delivery of audio or video recordings or computer software in a sealed package if the seal has been removed after delivery,
- Delivery of newspapers, magazines or periodicals with the exception of subscription contracts.
- We treat customer data confidentially and do not pass it on to third parties (see also the privacy policy below).
- In the event of a defect, the statutory warranty rights shall apply. However, defects or damage to the goods that are attributable to culpable or improper handling or use of the goods by the customer are excluded from the warranty. Furthermore, wear and tear due to normal use is also excluded from the warranty.
- We shall only be liable for damages other than those resulting from injury to life, limb and health insofar as these are based on intentional or grossly negligent action or on culpable breach of a material contractual obligation by us or one of our vicarious agents (e.g. the delivery service). Any further liability for damages is excluded. The provisions of the Product Liability Act remain unaffected. If an essential contractual obligation is negligently breached, our liability shall be limited to the foreseeable damage.
- Individual tickets cannot be returned.
- Purchase on account with installment facility (POWERPAY) Purchase on account with installment facility (POWERPAY)
MF Group / POWERPAY offers the payment method “Purchase on account” as an external payment service provider. With the single invoice you can easily pay your online purchase
by invoice. If you decide not to pay within the specified time frame, you will receive a monthly invoice with
order overview in the following month.
When the purchase contract is concluded, POWERPAY takes over the invoice claim and processes the corresponding payment modalities. When purchasing on
invoice, you accept POWERPAY’s GTC in addition to our GTC. (powerpay.ch/en/agb).
- The place of jurisdiction is Romanshorn (TG), Switzerland. The legal relationship is subject to the Swiss Code of Obligations, to the exclusion of the provisions of the Vienna Sales Convention and the provisions of international private law. Irrespective of this choice of law, consumers who have their permanent place of residence in a member state of the European Union at the time the contract is concluded may invoke the mandatory consumer protection provisions of their country of residence. The same applies to the place of jurisdiction.
